Trial date set for September in Joey Comunale murder case

NEW YORK — The first of two men charged with the brutal slaying of a 26-year-old Stamford man will go to trial this fall.

Manhattan Supreme Court Justice James Burke severed the cases against murder suspects James Rackover, 26, of New York, and Lawrence Dilione, 29, of Jersey City, N.J., Monday afternoon, each of whom is charged with murder, hindering prosecution, tampering with physical evidence and concealment of a corpse in the Nov. 13, 2016 killing of Westhill High School graduate, Joseph Comunale.

Police say a drug-fueled argument over cigarettes and cocaine led to the beating, strangling, stabbing and dismemberment of Comunale, whose body was found partially burned and buried in a shallow grave in Oceanport, N.J.

Rackover will be the first to go to trial beginning Sept. 24, after which a trial date will be set for Dilione.

A third defendant, Max Gemma, 30, of Oceanport, who is charged with hindering prosecution and tampering with evidence for allegedly misleading police during their investigation, is expected to go to trial last.
